General Terms and Conditions for Online Orders
1. Applicability and scope
1.1 The following General Terms and Conditions for Online Orders (hereinafter referred to as “GTC”) apply to all orders between Swiss Group International SGI AG (hereinafter referred to as “Swiss Group International SGI AG,” “us,” or ‘we’) and the customer (hereinafter referred to as “customer,” referred to as “Buyer” or ‘you’) for services (hereinafter referred to as “Services”) purchased via our online shop shop.swissgroupinternational.com (hereinafter referred to as
“Online Shop”). Our services are provided exclusively on the basis of the currently valid GTC and our privacy policy. These GTC and our privacy policy also apply to all future business relationships, even if they are not expressly agreed again.
1.2 You can access the current GTC at any time at shop.swissgroupinternational.com/agb.

1.4 Individual agreements concluded with the customer take precedence over these General Terms and Conditions. Conflicting general terms and conditions of the customer are not recognized.
1.5 Swiss Group International SGI AG reserves the right to amend these GTC at any time. All amendments shall take effect upon publication of the new GTC on the website. The decisive date for the applicability of the valid GTC when purchasing a service is the date on which the binding order is placed with us.
1.6 The contract language is exclusively German. If there is a conflict between the German text and the English text, the German text shall prevail.
[1.7] By placing a binding order for our services, you declare that you are legally competent and at least 18 years of age.
[1.8] The customer must note that, in addition to these General Terms and Conditions, the conditions of carriage of the respective operating airline specified on the ticket also apply. The conditions of carriage are an integral part of every contract. Insofar as the conditions of carriage of the respective operating airline deviate from the General Terms and Conditions of SGI, the conditions of carriage of the respective operating airline shall take precedence over the General Terms and Conditions of Swiss Group International SGI AG. Customers are therefore advised to read the conditions of carriage of the respective operating airline carefully. The conditions of carriage of the operating airlines can be found on the respective websites of the airlines. Restrictions and/or deviations may relate in particular to baggage and transport regulations, passenger rights, operational irregularities, and liability regulations.
2. Conclusion of a purchase contract
2.1 The presentation of services in the online shop does not constitute a legally binding offer, but merely a non-binding invitation to customers to order the service in the online shop. Swiss Group International SGI AG expressly reserves the right to change the services themselves as well as the content, such as images, product range, prices, and descriptions of our services, at any time and without prior notice. Illustrations, images, brochures, advertising, and other information related to our products are for informational purposes only and are not binding on Swiss Group International SGI AG.
2.2 The customer can place a binding order for the services they have selected via our online shop. The customer can place the services they select in the “shopping cart.” This does not yet constitute a binding order. An order is only considered binding once the customer clicks on the “Place order” button at the end of the ordering process on the order page. Before submitting the order, the customer can change and view the details at any time, identify any input errors, and correct them if necessary before the binding final submission of the order.
2.3 The customer will receive confirmation of receipt of the order by email. This email contains the details of your order and our terms and conditions, which you accepted during the ordering process, as well as a link to the airline's conditions of carriage. This email serves only to inform you that we have received your order. It does not constitute a purchase contract. By submitting your order, you confirm that you have read the terms and conditions and agree to them without reservation. We recommend that you print out or save the terms and conditions and the airline's conditions of carriage on your computer for the purpose of online ordering and your documentation. The invoice for your order will be sent to you in a separate email.
2.4 Once you have placed a binding order, Swiss Group International SGI AG is free to either accept the order at its own discretion or reject it by sending a corresponding notification by email and without assuming any liability towards you or third parties. We will refund any payment already made if the order is rejected. You remain bound to your order for 14 days.
2.5 Upon acceptance of the order by Swiss Group International SGI AG, a binding purchase contract is concluded with the customer. This acceptance is confirmed by express notification via email.
3. Availability and reservation of performance for unavailable products
3.1 All information about the availability of a flight is preliminary and approximate. It does not constitute binding or guaranteed contractual content. If Swiss Group International SGI AG determines during the processing of your order that the services you have ordered are unavailable, we will inform you accordingly. In this case, no contract will be concluded.
3.2 Furthermore, we reserve the right to limit the services that can be purchased by a customer. In this case, we will inform the customer accordingly by email.
4. Prices
4.1 Our services and prices correspond to those stated on the website. All prices are quoted in CHF (Swiss francs) for customers residing in Switzerland or the Principality of Liechtenstein. For customers residing in the European Union (EU), prices are quoted in EUR (euros). The total price of your order, including all additional costs (such as airport taxes), will be displayed at the end of the ordering process.
4.2 By placing a binding order, you declare that you agree to the total price for the services ordered. The price cannot be adjusted after the binding order has been placed.
4.3 Swiss Group International SGI AG reserves the right to change prices at any time. Services will be invoiced on the basis of the prices offered at the time the binding order is placed.
5. Terms of payment
5.1 The customer has the option of paying using the payment methods displayed on the website or during the ordering process. These may change from time to time and vary from country to country.
5.2 By selecting a payment method, the customer authorizes payment either by entering their credit card details or the login details of a payment service provider. The customer authorizes Swiss Group International SGI AG to accept payments via the selected method. In the event of chargebacks, Swiss Group International SGI AG is entitled to reimbursement of the associated costs and bank processing fees. Furthermore, Swiss Group International SGI AG is not liable for any fees or other amounts that the card issuer or your bank may charge you as a result of processing your payment in accordance with your order.
5.3 If you pay by credit card or an alternative payment method, we reserve the right to verify the validity of the card, check the availability parameters for collection and the address details, and request authorization from the card issuer or payment provider. You also confirm that the credit card is valid and that the payment details entered are correct. If payment is declined, Swiss Group International SGI AG reserves the right to cancel the order and not provide the services. In this case, we will contact you immediately.
5.4 When paying in advance, the customer will receive the invoice by email after the order has been received. Payment must be made using the payment slip or by specifying the payment reference within the payment period stated on the invoice. If payment is not made on time, Swiss Group International SGI AG reserves the right to cancel the order.
5.5 If the services are not available at the time of ordering, or if Swiss Group International SGI AG is only able to provide a partial service, any payments already made by the customer will be refunded immediately.
6. Provisions for booking flights
6.1 A flight booking is only valid for the flight booked and the person named on the booking. No ticket will be issued when booking via our online shop. A booking number will be issued. This must be presented at the check-in counter together with valid identification (ID card, passport) or entered during web check-in. The full first and last name provided at the time of booking must match the name on the identification document.
6.2 Cancellations or rebookings are subject to the guidelines of the contract of carriage between the customer and the operating airline.
6.3 Swiss Group International SGI AG accepts cancellations and rebookings from customers and forwards them to the relevant airlines. Any costs incurred are to be borne exclusively by the customer.
7. Special provisions regarding seat reservations
7.1 Customers may reserve or change seats up to 6 hours before departure. Swiss Group International SGI AG will immediately forward the seat reservations to the operating airline. Submitting a reservation does not guarantee the reserved seat. The seat is only guaranteed once the customer has received confirmation from Swiss Group International SGI AG.
7.2 The reservation of seats at the emergency exits is subject to special safety requirements imposed by the competent authorities. Swiss Group International SGI AG points out that the following persons are not permitted to sit in the exit row/emergency exits: 7.2.1 Expectant mothers;
7.2.2 Babies and children under 16 years of age;
7.2.3 Physically and/or mentally disabled persons;
7.2.4 Persons whose mobility is restricted due to their body mass, illness, or age;
7.2.5 Persons traveling with animals in the cabin; and
7.2.6 Persons accompanying passengers who require assistance in an emergency situation.
By reserving a seat at one of the emergency exits, the customer confirms that the above exclusion criteria do not apply to him or to any other person for whom the customer has made a booking.
[7.3] Swiss Group International SGI AG points out to the customer that reserving a seat at one of the emergency exits requires that the customer be prepared to assist the cabin crew in an emergency. This requires that the customer be able to follow the instructions of the cabin crew in German or English and meet the requirements set out in section 7.2. If this is not the case, Swiss Group International SGI AG and the operating airline are entitled to assign the customer a seat other than the one reserved. In this case, the customer is not entitled to a refund of the reservation costs. If it is not possible to assign the customer to another seat after exhausting all possibilities, the operating airline has the right to refuse the customer carriage altogether.
[7.4] In addition, the guidelines and conditions of carriage of the operating airline apply to seat reservations. In the event of conflicting provisions, the latter shall take precedence.
8. Special provisions for baggage, excess baggage, special and sports baggage, bulky items, and aids
8.1 The customer may request us to transport excess baggage, special baggage, sports equipment, bulky items, and aids.
8.2 Swiss Group International SGI AG and/or the operating airline may refuse or prematurely terminate the transport or onward transport of excess baggage, special baggage, sports equipment, bulky items, and aids if one or more of the following points apply. 8.2.1 The transport violates applicable law, applicable regulations, or requirements of the country of departure or destination or the country being flown over.
8.2.2 The carriage violates the guidelines or regulations for the transport of baggage of the operating airline.
8.2.3 The carriage would endanger the safety, order, or health of other passengers or crew members, or would constitute an unreasonable burden for such carriage.
8.2.4 The customer or other persons for whom the customer has made the booking refuses to undergo a security check of their person or luggage.
8.2.5 The customer has not paid the airfare, taxes, fees, surcharges, or other services to be provided by him.
8.2.6 The customer or other persons for whom the customer has made the booking is not in possession of valid travel documents or wishes to enter a country for which he is only authorized to transit or for which he does not have valid entry documents.
8.2.7 The baggage contains items that are capable of endangering passengers, cabin crew, the aircraft itself, or other items on board the aircraft, as listed in the IATA Dangerous Goods Regulations in their currently valid version. This includes, but is not limited to, explosives, oxidizing, radioactive or magnetizing substances, compressed and liquid gases, infectious or aggressive substances, and highly flammable substances.
8.2.8 The baggage contains items whose transport is prohibited by the regulations of the country from which the flight departs, to which it flies, or over which it flies.
8.2.9 The baggage contains individual lithium batteries or lithium accumulators, such as those from mobile phones, laptops, handheld devices, etc. These may only be carried in hand luggage.
8.2.10 Baggage Weapons of any kind, in particular cutting, stabbing, thrusting, and firearms, as well as spray devices used for attack or defense purposes, Ammunition and explosive hazardous materials, or items that, based on their external appearance or labeling, could be mistaken for weapons, ammunition, or similar explosive hazardous materials, without this having been reported prior to departure, and/or if they are not to be transported in accordance with the regulations for the transport of dangerous goods as cargo or checked baggage. The transport of weapons is at the reasonable discretion of SGI and the respective operating airline. In any case, they must be unloaded and transported in a locked, commercially available container. The carriage of ammunition is subject to ICAO and IATO dangerous goods regulations. If the customer intends to transport weapons of any kind or ammunition, they must contact SGI and the operating airline directly.
8.2.11 The baggage contains items that are dangerous or unsafe due to their weight, size, or nature, or due to their perishability, fragility, or particular sensitivity to transport.
8.3 If the aforementioned items are contained in the baggage and are discovered during security checks, the customer must remove these items from the baggage or they will be removed by the responsible security personnel. Swiss Group International SGI AG accepts no liability for items removed in this way. Any costs incurred by us for the storage of these items shall be borne by the customer. Swiss Group International SGI AG accepts no liability for any damage to the baggage item and its contents caused by the opening of the baggage item in this context.
8.4 Swiss Group International SGI AG forwards the baggage services purchased by the customer to the operating airline. It is the customer's responsibility to ensure that their baggage items meet the requirements of the operating airline.
8.5 Swiss Group International AG accepts no liability for the non-transport, damage, or other impairment of customers' baggage.
8.6 Changes or cancellations relating to baggage services will be forwarded by Swiss Group International SGI AG to the operating airline. The provisions of the operating airline apply. Any costs incurred shall be borne by the customer.
9. Special provisions for orders of in-flight meals
9.1 Swiss Group International SGI AG lists allergens in the in-flight meals, provided that we receive the information from the operating airline. It is the customer's responsibility to find out about any intolerances and to consult the cabin crew if necessary. Swiss Group International SGI AG accepts no liability for allergic reactions.
10. Cancellation policy for customers
10.1. There is no right of cancellation.
10.2 The right of withdrawal does not apply to orders for services that cannot be canceled due to the regulations of the operating airline.
11. Registration for a customer account
11.1 When you register for a customer account, you can view information about your completed orders and save your address details. Since your data is stored, you do not need to re-enter it when making another purchase. Registration creates a permanent customer account.
11.2 When registering for such an account, you are responsible for ensuring that the personal data required for registration is truthful and complete. You are obliged to treat your personal access data confidentially and not to make it accessible to unauthorized third parties. If you have any reason to believe that your customer account is being misused by third parties, you must inform us immediately.
11.3 Swiss Group International SGI AG guarantees to treat your data confidentially and not to pass it on to unauthorized third parties. 11.4 Registration is free of charge. Each customer is only entitled to maintain one customer account. We reserve the right to delete multiple applications and to warn, block, or delete or change the content of registered customers who violate these GTC or individual agreements.
11.5 Swiss Group International SGI AG is not obligated to accept the registration or order of a registered customer.
12. Liability
12.1 Exclusion for incorrect information
We receive information from the operating airlines and other service providers. Although we take the utmost care and act to the best of our knowledge and belief when providing our platform, we cannot guarantee that all information is correct. Unless we have acted with intent or gross negligence, we cannot be held responsible for incorrect information or missing information.
12.2 Liability for damages arising from transportation services
Liability for any type of damage, regardless of the legal basis, arising from or in connection with transportation is governed by the contract of carriage between the customer and the operating airline. Swiss Group International SGI AG cannot be held liable for this.
12.3 Liability for damages arising from our agency services
12.3.1 Towards customers from Switzerland and the Principality of Liechtenstein
12.3.1 We are liable without limitation for direct damages resulting from intent and gross negligence. In cases of slight negligence, we are liable for damages resulting from injury to life, limb, and health of persons.
12.3.2 Any further liability for additional damages arising from the contract or from tort, in particular but not limited to indirect damages, consequential damages, etc., is hereby completely excluded to the extent permitted by law.
12.3.3 Liability for auxiliary persons is excluded.
12.3.4 Furthermore, the total liability under these General Terms and Conditions, regardless of the reason and to the extent permitted by law, is limited to the price of the service ordered by the customer from us.
12.4 Towards customers from Germany and Austria
12.4.1 We are liable without limitation for intent and gross negligence. We are liable for slight negligence in the event of damage resulting from injury to life, limb, or health of persons.
12.4.2 Otherwise, the following limited liability applies: In cases of slight negligence, we shall only be liable in the event of a breach of a material contractual obligation, the fulfillment of which is essential for the proper execution of the contract and on the observance of which you may regularly rely. Liability for slight negligence is limited to the amount of damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. This limitation of liability also applies in favor of our legal representatives and vicarious agents.
12.4.3 In the event of a breach of essential contractual obligations, Swiss Group International SGI AG shall only be liable for foreseeable damage typical for this type of contract if this was caused by simple negligence, unless the customer's claims for damages arise from injury to life, limb, or health.
12.5 Exclusion of liability in cases of force majeure
12.5.1 In the event of an occurrence beyond our control (force majeure), we shall not be liable or responsible for the non-fulfillment (or delayed fulfillment) of obligations under these General Terms and Conditions, the contractual relationship based thereon, and/or the contract of carriage. Furthermore, we reserve the right to withdraw from the contract in such cases. An event beyond our control includes, for example, the following cases: Strikes, lockouts, or other actions by third parties, invasions, terrorist attacks, war, fire, explosions, storms, floods, earthquakes, epidemics, pandemics, other natural disasters, or the failure of public or private communication networks or the loss of usability of rail, shipping, air, motor vehicle routes, or other means of public or private transport.
12.5.2 If an event beyond our control occurs that affects the fulfillment of our obligations under the contract, we will inform you as soon as possible.
13. Data protection
13.1 When you use our website and contact us, various personal data is collected. Swiss Group International SGI AG collects and processes personal data only within the framework of legal provisions, in particular in compliance with applicable data protection laws. Further information on the processing of your personal data, your rights, and related issues can be found in our privacy policy. This is available at shop.swissgroupinternational.com/datenschutz. We may amend or supplement the privacy policy at any time.
13.2 Swiss Group International SGI AG must forward your personal data to the airline in order to provide the flight service. The airline may in turn be obliged to pass on the data to other third parties, such as airports, immigration authorities, etc. We therefore recommend that you consult the airline's data protection regulations.
14. Copyright
The information and content published on the website are protected by copyright and are the property of Swiss Group International SGI AG or the respective rights holder. Reproduction, editing, distribution, or any other form of exploitation requires the prior written consent of the respective rights holder. Swiss Group International SGI AG and the respective rights holder expressly reserve all rights in this regard.
15. Severability clause
Should any provision of these GTC be or become unlawful, invalid, or unenforceable for any reason, this shall not affect the validity of the remaining provisions. Unless otherwise agreed, the invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the provision and the intention of the parties at the time the contract was concluded. The same applies to any gaps in these GTC.
16. Online dispute resolution
16.1 For consumers residing in Switzerland

Swiss Group International SGI AG is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
17. Applicable law and place of jurisdiction
These GTC, the contractual relationships based on them, and any disputes shall be governed exclusively by Swiss substantive law, excluding the Hague Convention and other international agreements as well as the International Private Law Act (SR 291), subject to mandatory legal provisions.
The exclusive place of jurisdiction is our registered office. The mandatory places of jurisdiction provided for by law remain reserved. We also reserve the right to take legal action against you at your ordinary place of jurisdiction.
These provisions shall only apply insofar as there are no mandatory provisions of the law of the country in which the consumer has his habitual residence that take precedence over these GTC. These GTC replace all previous general terms and conditions.
